Open adoptions are occurring more frequently according to a recent report by the Evan B. Donaldson Adoption Institute. The report found that today in 95% of infant adoptions some type of ongoing relationship continued with the birth parent and 55% of those are “fully open,” meaning the parties have expressly agreed to ongoing contact.
Some clients have contacted our firm with questions about whether open adoptions are legal in Missouri. Although there are no statutory provisions that prevent open adoptions, there are no laws that dictate the procedure, the terms or the enforcement of an open adoption agreement.
It is vital to manage all parties expectations for post-adoption contact. If you have questions about open adoptions in Missouri, contact us for more information.
